Terms of Service

Please read these Terms of Service (“Terms”) carefully before using FootPrints at footprints.websiteand our iOS application (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and FootPrints. We may update these Terms at any time. We will notify you of material changes by email or an in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use FootPrints. If you are between 13 and 18, you confirm that you have obtained parental or guardian consent. By creating an account you represent and warrant that you meet these eligibility requirements and that the information you provide is accurate and complete.

3. Your Account

3.1 Registration

You may register with an email address and password, or through Google Sign-In. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3.2 Account Security

You agree to notify us immediately at support@footprints.website if you suspect unauthorised access to your account. We are not liable for losses arising from unauthorised use of your account.

3.3 One Account Per Person

You may not create multiple accounts or use another person's account without permission.

4. The Service

FootPrints allows couples and close partners to:

Pin geolocated memories (photos, titles, dates) on a shared map
Connect with a partner using a pairing code
View a timeline of shared memories
Create and share photo albums
Receive proximity notifications when near a shared memory

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will endeavour to provide reasonable notice for material changes that affect your existing data.

5. User Content

5.1 Ownership

You retain full ownership of all content you upload to FootPrints, including photos, memory titles, and any other material (“User Content”).

5.2 Licence to Us

By uploading User Content, you grant FootPrints a limited, non-exclusive, royalty-free, worldwide licence to store, process, and display your User Content solely for the purpose of providing the Service to you and your connected partner. We do not use your content for advertising or share it with third parties beyond our infrastructure providers.

5.3 Prohibited Content

You agree not to upload content that:

Is illegal, obscene, defamatory, or infringes a third party's intellectual property rights
Contains malware, spyware, or other harmful code
Depicts non-consensual sexual acts or minors in a sexual context
Violates any applicable law or regulation

We reserve the right to remove content that violates these restrictions and to suspend or terminate accounts of repeat offenders.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorised access to another user's account or our systems
Scrape, crawl, or extract data from the Service using automated means
Reverse-engineer, decompile, or disassemble any part of the Service
Use the Service to harass, stalk, threaten, or harm any person
Impersonate any person or entity
Transmit spam or unsolicited commercial messages

7. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the processing of your data as described in the Privacy Policy.

8. Intellectual Property

All intellectual property rights in the Service (excluding User Content) — including the FootPrints name, logo, design, software, and features — are owned by or licensed to FootPrints. Nothing in these Terms grants you a right to use our trademarks, logos, or proprietary information without our prior written consent.

9. Third-Party Services

The Service integrates with third-party services including Google Maps and Google Firebase. Your use of these integrated services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for the accuracy, completeness, or usefulness of any User Content.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOOTPRINTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ₹500 (FIVE HUNDRED INDIAN RUPEES).

12. Indemnification

You agree to indemnify and hold harmless FootPrints and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

13. Termination

13.1 By You

You may stop using the Service and delete your account at any time. Account deletion removes all your data in accordance with our Privacy Policy.

13.2 By Us

We may suspend or terminate your account immediately, without notice, if you violate these Terms or if we reasonably believe your use of the Service poses a risk of harm to others or to FootPrints.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases. Sections 5.2, 8, 10, 11, and 12 survive termination.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be addressed by contacting us at support@footprints.website. If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
